Requests for Litigation Funding and Amicus Participation
To establish good legal precedent for older Americans and individuals with disabilities, the Foundation awards grants to NAELA members and chapters that litigate issues that are of importance to NAELA members and the clients they serve.
NAELA’s Litigation Committee regularly reviews applications and provides recommendations to the NAELA Board of Directors for requests to fund litigation or participate as an Amicus Curiae.
When evaluating such requests, the Litigation Committee shall consider whether the case could favorably support or reform the law in an area affecting older adults and individuals with disabilities and impact their legal rights in a significant way. NAELA shall not participate in cases that merely turn on a particular set of facts as opposed to setting or supporting precedent on an underlying legal principle affecting older adults or individuals with disabilities. Typically, these cases will be at the highest court of a state, a federal Court of Appeals, or the Supreme Court of the United States.
