NAELA Lobbies to Prevent the End of the Mandate for Spousal Impoverishment Protections in HCBS

NAELA is working closely with Justice in Aging and the National Council on Aging to pass an extension of the mandate from the Affordable Care Act, which required Medicaid's spousal impoverishment protections for nursing home coverage also apply to HCBS waivers. The mandate expires at the end of the year. Thanks to these efforts, Reps. Debbie Dingell (D-MI) and Fred Upton (R-MI) introduced The Protecting Married Seniors from Impoverishment Act.

"Individuals who require assistance with daily activities should be allowed to age in place and not be forced to go into a nursing home simply to protect their spouse from becoming poor," said NAELA President Michael Amoruso, Esq., CAP, Fellow.
